For contact details, orders, cancellations or complaints, please visit the Contact page available on our website.

Hereinafter, the company will be referred to as "La-Vali", "the restaurant" or "the operator".

2. Acceptance of Terms and Conditions

By accessing and using the website, users acknowledge that they have read these Terms and Conditions.

Using the online ordering services implies acceptance of these Terms and Conditions.

If a user does not agree with the provisions of this document, they should refrain from using the relevant services.

This document applies to website users and customers using La-Vali's online ordering services.

3. User Accounts and Access to Ordering Services

An account and authentication are required to place online orders.

Orders may only be placed by users who have been granted the Client role following the verification and approval process carried out by the platform administrator.

This process includes:

  1. Creating a user account;

  2. Verifying the email address;

  3. Requesting the Client role;

  4. Checking the address to establish eligibility within the delivery area;

  5. Telephone confirmation;

  6. Approval of the request by an administrator.

The restaurant serves Alexandria and nearby localities where delivery can be provided. Address eligibility is determined during the approval process.

Users are responsible for ensuring that the information in their profiles is accurate and up to date, particularly their telephone number and delivery address.

Accounts are intended for use by their respective holders. Users must keep their login credentials confidential and notify the restaurant if they suspect unauthorized access to their accounts.

4. Products and Menu

La-Vali publishes information about available food products on its website, including the daily menu and other products offered by the restaurant.

Product availability may vary depending on the day, restaurant operating hours, stock and preparation capacity.

The publication of a product on the menu does not guarantee its permanent availability.

The restaurant may update menus, descriptions, images and prices whenever necessary.

The applicable price is the price displayed on the website when the order is placed.

The displayed price is the final price payable by the customer. No additional taxes, hidden fees or delivery charges are added afterwards.

The total order amount is presented to the customer before the order is submitted.

If a product becomes unavailable after an order has been submitted, the restaurant will inform the customer and agree with them whether to proceed with the available products or cancel the order.

5. Placing and Confirming Orders

Orders are submitted through the online ordering functionality available on the website.

Before submitting an order, customers must check:

  • The selected products;

  • Quantities;

  • Total order amount;

  • Delivery address;

  • Telephone number and other details required to fulfil the order.

Submitting an order represents the customer's request to purchase the selected products.

The restaurant reviews the request and checks product availability.

An order is accepted when the restaurant confirms its acceptance to the customer. Confirmation is provided by email or through other communication methods used by the restaurant.

Where acceptance is confirmed by telephone, the restaurant may also send an email confirmation so that the customer can retain written evidence of acceptance.

An automatic notification confirming that an order has been received should not be confused with acceptance of the order by the restaurant.

The restaurant may contact the customer to clarify information required before accepting an order.

6. Prices and Payment Methods

Product prices are displayed on the website in Romanian Lei (RON).

The total order amount is shown before the user submits the order.

Currently, orders are paid for exclusively in cash upon delivery, directly to the courier.

La-Vali does not currently request online card payments or collect bank account or payment card details through the ordering process.

Any changes to available payment methods will be communicated through the website and, where applicable, through an update to this document.

7. Order Delivery

Delivery is available in Alexandria and nearby localities served by the restaurant.

Address eligibility is checked during the Client role approval process.

Delivery is free of charge. No additional delivery fee is charged for orders placed under the current service conditions.

Orders are delivered to the address specified in the customer's profile.

Customers must provide an accurate address and a telephone number at which they can be reached.

The restaurant may contact customers to clarify delivery details or coordinate delivery.

Preparation and delivery times may vary depending on order volume, product availability, restaurant operating hours and traffic conditions.

If delays or difficulties affect delivery, the restaurant will make reasonable efforts to inform the customer and resolve the situation.

8. Restaurant Opening Hours and Order Availability

The restaurant's opening hours are managed by the restaurant and may be updated on the website.

Online orders are available only during the periods in which the restaurant allows orders to be placed.

Outside operating hours, or when online ordering is temporarily disabled, users cannot submit online orders.

The restaurant reserves the right to temporarily suspend order intake when operational, technical or other circumstances prevent orders from being properly fulfilled.

9. Order Cancellation

Currently, the platform does not provide a button allowing customers to directly cancel an order that has already been submitted.

To request cancellation, customers must contact the restaurant by telephone using the contact details provided on the website.

Customers are encouraged to request cancellation as soon as possible, before preparation or delivery has progressed.

The restaurant will review the request and inform the customer whether cancellation is still possible, taking into account the preparation and delivery stage.

Order cancellations are recorded in the system by authorized restaurant staff.

If the restaurant cannot fulfil an accepted order, the customer will be informed and provided with an explanation of the situation and the next steps.

Nothing in this section limits the customer's statutory rights.

10. Food Products, Quality and Complaints

The restaurant aims to prepare and deliver ordered products in appropriate quality and food safety conditions.

If a customer discovers that:

  • They received a product different from the one ordered;

  • A product is missing from the order;

  • A product has quality issues;

  • The order arrived in an unsuitable condition;

  • Any other issue has occurred with the order,

they are encouraged to contact the restaurant by telephone as soon as possible after receiving the order.

To investigate a complaint, the restaurant may request information about the order and, where relevant, photographs of the product or packaging.

Each complaint will be assessed according to the specific circumstances, while respecting the customer's statutory rights.

Legal rights concerning product conformity, food safety and consumer protection are not limited by this document.

11. Right of Withdrawal and Specific Characteristics of Food Products

Consumer legislation concerning distance contracts generally provides a 14-day right of withdrawal, but also establishes certain exceptions.

In particular, Article 16 of Government Emergency Ordinance No. 34/2014 provides exceptions for goods liable to deteriorate or expire rapidly.

Freshly prepared food intended for consumption within a short period may fall within this category, depending on the nature of the product and the specific circumstances.

Therefore, the general 14-day right of withdrawal does not automatically apply to all food orders.

This provision does not affect the customer's rights in cases involving non-conforming products, incorrectly delivered products or other situations for which the law provides remedies.

For any issue concerning an order, customers may contact the restaurant by telephone.

12. Information About Ingredients and Allergens

Customers with allergies, food intolerances or other dietary restrictions should request the necessary information from the restaurant before placing an order.

Information about ingredients and allergens must be considered in relation to the specific product and its preparation method.

Customers are encouraged to contact the restaurant before ordering if they need clarification about the composition of a dish.

The restaurant will provide the available information about its products in accordance with applicable legal requirements.

13. Online Reservations and Other Features

The website may display sections or interfaces intended for services that are still under development.

As of the latest update of this document, online reservations are not available to customers. The table selection interface does not currently allow reservations to be made.

The mere presence of a section or button on the website does not mean that the relevant service is available.

If online reservations or other new services are introduced, the applicable terms of use will be updated before their launch, where necessary.

14. Newsletter and Public Communications

La-Vali may send information about the restaurant, the daily menu and articles published on its blog through its newsletter.

Newsletter subscriptions are voluntary and separate from placing orders.

The restaurant also operates a public Telegram channel through which general information about its activities is shared.

These communications do not replace individual notifications required for order management.

Details regarding the processing of personal data are provided in the Privacy Policy.

15. Accounts and Improper Use

Users must use the platform lawfully and responsibly.

The following activities are prohibited:

  • Intentionally providing false information;

  • Using another person's account without authorization;

  • Submitting fictitious or abusive orders;

  • Attempting unauthorized access to the platform;

  • Using the services for unlawful purposes;

  • Any action that affects the security, operation or availability of the website.

If abusive or fraudulent activities are identified, the restaurant may take proportionate measures, including restricting access to platform services, in accordance with applicable law.

16. Intellectual Property

The content of the La-Vali website, including texts, photographs, images, graphic elements, logos and published materials, is protected by copyright and intellectual property legislation, where applicable.

Reproduction, distribution, modification or commercial use of materials without the consent of the rights holder is prohibited, except where permitted by law.

Use of the website does not grant users any ownership rights over the published content.

17. Website Availability and Limitation of Liability

La-Vali makes reasonable efforts to maintain the proper functioning of the website and its available services.

Temporary interruptions may occur due to maintenance, technical issues, service providers or other circumstances beyond the restaurant's control.

The restaurant cannot guarantee uninterrupted platform availability but will make reasonable efforts to resolve any problems that arise.

Nothing in this document excludes or limits liability that cannot be excluded or limited under applicable law.

18. Complaints and Dispute Resolution

If a customer experiences a problem relating to an order, product or service provided by La-Vali, they may contact the restaurant directly by telephone using the contact details available on the website.

PICDOMINIC BESTSERV SRL will review the complaint and make reasonable efforts to clarify and resolve the matter amicably.

Consumers also have the right to contact the National Authority for Consumer Protection (ANPC) through its official channels:

Contacting the restaurant in an attempt to resolve a matter amicably does not restrict or replace the consumer's right to contact the competent authorities.

19. Personal Data Protection

The processing of personal data in connection with the use of the website and the placement of orders is described in the separate document:

Privacy Policy: https://la-vali.com/ro/politica-de-confidentialitate

Users are encouraged to consult this policy to understand how their personal data is collected, used and retained.

20. Changes to the Terms and Conditions

La-Vali may update this document when legislative, technical or operational changes occur, or when new services are introduced.

The updated version will be published on https://la-vali.com/.

Changes will not retroactively affect the rights and obligations arising from orders already accepted, except where permitted by law.

Users are encouraged to review this page periodically.

21. Applicable Law

This document is governed by Romanian law and applicable European Union legislation.

Any disputes will be resolved amicably or, if this is not possible, by the competent courts in accordance with applicable law.

Nothing in these Terms and Conditions limits consumer rights granted by mandatory applicable legislation.
